Terms of Service
IBD Better is a wellness application. It is not diagnostic, it is not a medical device, and it is not a replacement for medical care. Always seek the advice of your clinician or another qualified health professional with questions about symptoms, treatment, medication, diet, or care decisions.
These Terms of Service ("Terms") govern your use of the IBD Better mobile application and related services (the "Service") provided by Bly-Baret LLC ("IBD Better," "we," "us," or "our").
By creating an account or using IBD Better, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use IBD Better.
2. What IBD Better Is
IBD Better is a consumer health tracking and journaling tool designed to help users log symptoms, food, medications, and related information and view AI-assisted summaries and patterns over time.
3. What IBD Better Is Not
IBD Better is not a medical device, healthcare provider, emergency service, diagnostic tool, or treatment service. IBD Better does not provide medical advice, diagnosis, or treatment recommendations. AI-generated outputs may be incomplete, inaccurate, or not appropriate for your situation.
Do not use IBD Better for emergencies. If you think you are having a medical emergency, call 911 or seek immediate medical care.
4. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. You agree to provide accurate registration information and keep it up to date. We may suspend or terminate accounts that violate these Terms, present security risk, or misuse the Service.
5. Trial Accounts
IBD Better may offer trial access. Trial eligibility, duration, and features may change at any time. To support trial continuity and abuse prevention, IBD Better may associate a trial account with a persistent device identifier.
6. Your Data
You retain rights in the content and data you submit to IBD Better. You grant IBD Better a limited, non-exclusive right to host, store, process, reproduce, and use your submitted data only as needed to operate and provide the Service; generate outputs and app features you request; maintain security, prevent abuse, and troubleshoot issues; improve the Service using aggregated or de-identified information; comply with law; and enforce these Terms. Our data practices are described in the Privacy Policy.
7. Acceptable Use
You agree not to use the Service for unlawful, fraudulent, or harmful purposes; interfere with the security or operation of the Service; attempt to access another user's account or data; reverse engineer or attempt to extract source code except where prohibited by law; upload malware or harmful code; misrepresent your identity or impersonate another person; or use the Service in a way that could harm IBD Better, other users, or third parties.
8. AI Features
IBD Better may use third-party AI providers to process content you submit, including health-related entries, in order to provide app features. Our third-party AI providers are contractually prohibited from using your data to train their own models.
IBD Better may use aggregated, de-identified data across users to develop and improve its own features and algorithms. This data cannot be traced back to you. You understand and agree that AI outputs may contain errors, AI outputs are informational only, and you remain responsible for how you interpret or act on any output.
9. Availability And Changes
We may modify, suspend, or discontinue all or part of the Service at any time. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date. Continued use after the updated Terms take effect means you accept the updated Terms.
10. Privacy Requests And Account Deletion
To request deletion or exercise privacy rights, contact privacy@ibdbetter.com. We may require identity verification before acting on a request.
11. Intellectual Property
The Service, including the IBD Better name, branding, software, design, and other content excluding your submitted data, is owned by Bly-Baret LLC or its licensors and is protected by applicable law. Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works from the Service.
12. Disclaimer Of Warranties
The Service is provided "as is" and "as available" to the maximum extent permitted by law. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
13. Limitation Of Liability
To the maximum extent permitted by law, Bly-Baret LLC and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, use, or data.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim or $100. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Bly-Baret LLC and its affiliates, officers, employees, and agents from claims, losses, liabilities, and expenses arising from your misuse of the Service, your violation of these Terms, or your violation of another person's rights.
15. Disputes
Before filing a formal claim, you agree to contact support@ibdbetter.com and try to resolve the dispute informally for at least 30 days. Except where prohibited by law, disputes arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and not as a class, consolidated, or representative action.
Either party may bring an individual action in small claims court if eligible, or seek injunctive relief for misuse of intellectual property, unauthorized access, or misuse of data.
16. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except to the extent preempted by applicable law.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
18. Entire Agreement
These Terms and the Privacy Policy form the entire agreement between you and Bly-Baret LLC regarding the Service.
